STANDARD STATEMENTS

The statements below are to be included in event notices. For topic specific language, see the Public Involvement Chapter (Part 1, Chapter 11) of the PD&E Manual.

NEPA Assignment

The environmental review, consultation, and other actions required by applicable federal environmental laws for this project are being, or have been, carried out by the Florida Department of Transportation (FDOT) pursuant to 23 U.S.C. § 327 and a Memorandum of Understanding dated May 26, 2022, and executed by the Federal Highway Administration and FDOT.

Civil Rights Act of 1964

Public participation is solicited without regard to race, color, national origin, age, sex, religion, disability, or family status. Persons who require special accommodations under the Americans with Disabilities Act or persons who require translation services (free of charge) should contact ___________ at _________ at least seven days prior to the meeting.

      Public Meeting

      Reminder that meeting notices should include:

      • The purpose of the meeting
      • A description of the project
      • The in-person date, time, and location and virtual broadcast date, time and registration
      • Standard statements
        • NEPA Assignment standard statement
        • Civil Rights Act of 1964 standard statement
        • Title VI contact information
        • Information for ADA requests  as provided in Section 11.6.2 of Part 1, Chapter 11 of the PD&E Manual

      Public Hearing

      Reminder that hearing notices should include:

      • The purpose of the public hearing
      • An explanation of the format of the public hearing
      • The project description (the use of a project location map is suggested)
      • The date, in-person location, start times (in-person open house and in-person formal presentation), and how to participate in the virtual broadcast
      • A list of places, dates, and times where the Environmental Document and other materials will be available for public inspection
      • Standard statements (as provided in Section 11.6.2 of Part 1, Chapter 11 of the PD&E Manual)
      • Contact information for where written comments are to be sent
       
      Type 2 Categorical Exclusion
       
      Environmental Assessment

      Reminder that EA hearing notifications must, in addition to the list at the top of this section, include:

      • Availability of the EA for public inspection for 30 days (15 days prior to the hearing and 15 days after the hearing)
      • Locations where the EA can be obtained or reviewed by the public. Suggestions include:
        • District office
        • At the public hearing
        • And on the project website
      • Comment period information: invites comments submitted in writing during the 30-day availability period of the EA

      Environmental Impact Statement

      Reminder that EIS hearing notifications must, in addition to the list at the top of this section, include:

      • Availability of the DEIS for public inspection for a minimum of 15 days prior to the hearing (per 23 CFR § 771.123(h), (i) and (j))
      • Locations where the DEIS can be obtained and reviewed by the public. Suggestions include:
        • At the District Office
        • At the public hearing
        • On the project website (USDOT Order 5610.1D, 13k(2))
        • And in other formats or hard copies by request
      • Invites comments submitted on the DEIS
